A REGULAR MEETING OF THE BOARD OF COUNTY COMMISSIONERS

FEBRUARY 16, 1982

The Lake County Board of County Commissioners met in regular session on Tuesday, February 16, 1982, in the County Commissioners' Meeting Room, Tavares, Florida. Commissioners present were: James R. Carson, Jr., Chairman; Thomas J. Windram; Claude Smoak; C. A. "Lex" Deems; and Glenn C. Burhans (arrived at 9:15 a.m.). Also present at the meeting were the following: James C. Watkins, Clerk; Christopher C. Ford, County Attorney; and Cathy B. Roy, Secretary.

The invocation was given by Mr. Watkins and the pledge of allegiance was led by Commr. Smoak.

MINUTES

On a motion by Commr. Smoak, seconded by Commr. Deems and carried unanimously, the Board approved the Special Minutes of February 9, 1982, as submitted.

On a motion by Commr. Windram, seconded by Commr. Smoak and carried unanimously, the Board approved the Regular Minutes of February 9, 1982, as amended.

COMMUNICATIONS/PUBLIC WORKS/ROADS - COUNTY & STATE

Commr. Windram stated that he had received a letter of request from residents of Harbor Shores for the County to study the roads in their area and inform them what was needed to bring the roads up to County standards. On a motion by Commr. Windram, seconded by Commr. Smoak and carried unanimously, the Board directed the Public Works Department to do the necessary study on these roads to inform the residents what was needed to bring the roads up to County standards.

LAWS AND LEGISLATIONS/VETERANS SERVICES

Commr. Carson stated that a letter had been received from Mr. Ralph Haben, Speaker of the House of Representatives, regarding the Resolutions approved by the County Commissioners opposing a transfer of the Division of Veteran's Affairs under the Department of Administration. Commr. Carson stated that the bill had been passed by the time the resolution had reached the State Association of County Commissioners.

COMMUNICATIONS/VETERANS SERVICES

Commr. Carson read a letter from Mrs. Clark of Mt. Dora

expressing thanks to the Veterans Services Officer, Art Ragland,

for the excellent service he is rendering to the Veterans and their families. The Board directed that the letter be forwarded to Mr. Ragland.

COMMUNICATIONS/EMERGENCY SERVICES

Commr. Carson stated that a letter had been received from Joan M. Heggen, Department of Veteran and Community Affairs regarding Rule 9G-11 on mandating certain costs to the County in connection with Emergency Services. Commr . Carson stated that he would talk with Bob Lewis, Emergency Services, regarding the impact of this rule and report back to the Board at a later date

REPORTS

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board acknowledged receipt of the Distribution of Revenue/Traffic/Criminal Cases for February 5, 1982.

HEALTH DEPARTMENT/REPORTS

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board acknowledged receipt of the Semi-  Financial Statement from the Lake County Health Department.

REPORTS

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board acknowledged receipt of the Annual Report for 1981 from the Department of Transportation,

BONDS/FIRE DISTRICTS

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board accepted the bonds for the members of the Northwest Lake County Hospital District, as submitted.

REPORTS

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board authorized the Chairman to sign the monthly status report from Youth Programs, Inc., covering the period from December 29, through January 31, 1982.

HOUSING FINANCE AUTHORITY

At this time Mr. Samuel Mazzotta, Executive Director for the Orange County Housing Finance Authority, addressed the Board and stated that the Orange County Housing Finance Authority had unanimously directed him to work with Lake County concerning the Housing Finance Authority for Lake County. Mr. Mazzotta updated the Board on the progress of the Orange County Housing Finance Authority and answered some of the questions of the Board. Mr. Mazzotta stated that proposals would be received from bond underwriters and bond council in a meeting to be held February 23, 1982, and suggested that a representative from Lake County attend this meeting.

Discussion occurred regarding the formulation of an ad hoc committee comprised of lending institution representatives.

On a motion by Commr. Smoak, seconded by Commr. Deems and carried unanimously, the Board authorized the Chairman to schedule an informational meeting with area lending institutions to determine those interested in serving on a committee to advise the Lake County Housing Finance Authority.

On a motion by Commr. Smoak, seconded by Commr. Deems and carried unanimoulsy, the Board authorized the Chairman to bring the names of those interested in serving on the committee before the Board at their meeting of March 2, 1982, in order that the Board can appoint members to the ad hoc committee.

The Board was informed by Sandra Stockwell, Assistant County Attorney, that a rough draft of an interlocal agreement was being prepared by the County Attorney's Office and would be forwarded to the Commissioners by the end of this week for their review.

Mr. Mazzotta informed the Board that he would be in Lake County each Monday morning from 8:30 a.m. until 12:00 noon, to answer any questions and work with the staff on the Lake County Housing Finance Authority.

CETA

Mr. James Flowers, CETA Director, addressed the Board and explained the Modification I to the CETA Comprehensive Employment and Training Plan. Mr. Flowers informed the Board that nationwide CETA funding is still under a Congressional Continuing Resolution until March 15, 1982, and that a further modification might be necessary.

On a motion by Commr. Smoak, seconded by Commr. Windram and carried unanimously, the Board approved Modification I to the CETA Comprehensive Employment and Training Plan.

Mr. Flowers stated that the Prime Sponsor Planning Council now had a full staff and stated that he felt this was an excellent group of people. Mr. Flowers stated that he would be coming before the Board at a later date to confirm appointments to the Planning Council.

COUNTY ATTORNEY/ORDINANCES/MOBILE HOME ADVISORY BOARD

Christopher C. Ford, County Attorney, supplied the Board with a memorandum concerning secret ballots by the County Commission in the selection of members of the Lake County Mobile Home Advisory Board. Mr. Ford stated that it was the opinion of the County Attorney's Staff that even though the ballots would be read publicly thereby cancelling the effects of the secret ballot, there was an opinion that the secret ballot taken would not remove the possibility of a criminal violation due to the secret ballot and it was the recommendation of the County Attorney's Office that there be no secret balloting.

INSURANCE

Commr. Carson stated that the representative from Gulf Life had informed the Insurance Committee that for the first time losses on the health and accident insurance exceeded the premiums and a rate increase was expected. Commr. Carson stated that he would keep the Board informed of this matter,

PUBLIC WORKS

At this time Rev. James Watson addressed the Board and requested that Lake County supply fill dirt for a new building to house the Groveland Farm Workers Clinic. Rev. Watson stated that the fill dirt to bring the property up was necessary to pass the percolation tests of the County and that approximately 3,000 yards would be required.

Mr. Herb Mansfield addressed the Board and explained some of the services rendered by the Farm Workers Clinic and stated that this was a non-profit organization presently funded partially from federal funds. Mr. Mansfield stated that he had information concerning the corporation available if necessary. Commr. Burhans stated that he would like a recommendation from Dr. Atkinson, Lake County Health Department, prior to consideration of this request. The County Attorney's Office was directed to research the corporation regarding any legal requirements in approving this request.

Commr . Carson requested that Rev. Watson clarify the request and Rev. Watson stated that they would provide the labor to remove and transport the fill dirt and the only request was that the County supply the dirt.

Mr. Mansfield and Rev. Watson were informed that this request would be researched by the County Attorney's Office, the Public Works Department, to determine if the fill was available, and brought back before the Board for consideration in a timely manner.

CODE VIOLATIONS

Mr. Glen Townsend addressed the Board concerning possible code violations by the Oak Lane Trailer Park, west of Clermont. Mr. Townsend stated that he had reported violations to the Code Enforcement Office and that representatives from that office had informed him that this park was not in violation. Mr. Townsend stated concern over the parks not complying with the site plan submitted and felt that the park was in violation. Commr. Carson stated that the Code Enforcement Office was very diligent in their work and if there was, in fact, violations occurring that this Board would have been made aware of it.

Mr. Townsend stated that he felt no action was being taken by the Code Enforcement Office on his allegations and that new trailers coming into the parks are not meeting requirements and that he did not want to see the parks building up as they have in the past.

PLANNING DEPARTMENT

On a motion by Commr. Smoak, seconded by Commr. Deems and carried unanimously, the Board approved the appointment of Ms. Patricia Myer, Clermont, to the Planning and Zoning Commission, subject to possible changes in the make-up of the Commission.

RECESS AND REASSEMBLY

There being no further business to be brought before the Board in the morning session, the Chairman recessed the meeting at 10:50 A.M., with each Commissioner lunching individually today, and stated the meeting would reconvene at 2:00 P.M. for the Public Works Agenda.

PUBLIC WORKS AGENDA

ROAD CLOSING - Vacate Lots and portion of Second Street

in the Town of Okahumpka

No one was present to discuss this closing with the Board.

It was noted that the proper proof of publication was on hand and had appeared in the January 26 and February 6, 1982, editions of the Sentinel Star, Little Sentinel.

On a motion by Commr. Deems, seconded by Commr. Burhans and carried unanimously, the Board approved the vacation of Lots and a portion of Second Street in the Town of Okahumpka for Harris and Atchely, as per Petition No. 282, described as follows:

Lots 11, 12, 13 and 14, Block B; and Lot 7, Block M; and also that portion of Second Street lying South of Block B and North of Block M in the Town of Okahumpka, according to the Plat thereof as recorded in Plat Book 1, page 38, Public Records of Sumter County, Florida, now being in Lake County, Florida, Section 15, Township 20 South, Range 24 East.



ROAD CLOSINGS - Permission to Advertise

Mr. and Mrs. Jack Lynady were present to answer any questions of the Board concerning Petition No. 283. Mr. Lynady stated that he had sent a certified letter to the property owner and although the certified card had been returned as being received, he had not received any reply from Mrs. Newton. Mike Willett stated that his department had sent a certified letter but had received neither the card nor a reply.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board postponed this request for thirty days and directed Mike Willett to again try to contact the other property owner that would affected by this closing and bring it back before the Board.

ROAD CLOSINGS - Permission to Advertise

No one was present to discuss this request with the Board. On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board denied the request to advertise the vacation of right of way between Block 39 and 70, Blocks 70 and 71, lying north of C-452, the west l/2 between Blocks 39 and 50, and also the south l/2 of the right-of-way north of Blocks 39, 70, and 71 east of C-452 in Section 11, Township 18 South, Range 23 East, Lake County, Florida, Unrecorded Plat of Higley for Keith Shamrock, as per petition No. 284. Commr. Smoak questioned whether Mike Willett would be informing Mr. Shamrock of the reasons for denial and Mr. Willett stated that this would be done.

ACCOUNTS ALLOWED/BUILDING DEPARTMENT

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved the request for Herb Dudgeon, Building Official and Don Smale, Deputy Building Official, to attend the Building Association of Florida Annual Meeting in Daytona Beach on March 1 through 3, 1982, at an estimated cost of $130.00.

PUBLIC WORKS

On a motion by Connnr. Windram, seconded by Commr. Burhans and carried unanimously, the Board approved repair of Swan Road for G. R. Bartling at a cost of $250.00 on one-time maintenance.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved report of Richard Court for Wayne Teeter at a cost of $60.00 on one-time maintenance.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved repair of Jacaranda Road for Bill Eyerly at a cost of $150.00 on one-time maintenance.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved repair of Jacaranda Road for Bill Eyerly at a cost of $150.00 on one-time maintenance.

BIDS/PUBLIC WORKS

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board awarded the bid on Project #5-82 2-5007 Myer Road, Z-4905 Edgewood Road, 2-5105 Selman Road, Z- 805 Woodbine Lane and l-4119 Sunnyside Cut-off Design Build Construction Lump Sum to Hewitt Contracting Company, Inc., in the amount of $92,863.20, low bidder. Mike Willett informed the Board that this worked out to an estimated $14.98 per foot.

DEEDS

On a motion by Commr. Deeems, seconded by Commr. Burhans and carried unanimously, the Board approved release of Road Reservations from DOT contained in the following Deed Numbers:

#1306, all but 33 feet from the centerline of C-561

# 977, all but 25 feet from the centerline of Oak Lane

BONDS - MOBILE HOME

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board approved the renewal of a mobile home bond for Samuel C. Kephart - Mt. Plymouth Area - District #4.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved the cancellations of mobile home bonds for Mr. Monti Young, Mrs. Cyril L. Geiger and Mr. Antrim Sundermin in that the conventional dwelling units had been completed and the mobile homes have been removed from the properties.

PUBLIC WORKS

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved that the County supply a load of fill to the Astor Cemetery.

PUBLIC WORKS/ROADS - COUNTY & STATE

On a motion by Commr. Windram, seconded by Commr. Burhans and carried unanimously, the Board approved the request received from the residents of County Road #4-6280, Griffin Road, to change the name of the road to Thrill Hill Road and erect new signs on the road designating it Thrill Hill Road.

LAWS & LEGISLATION

Commr. Carson stated that he had received a letter from the Office of the Governor requesting the Board support his position on the 1/2c local option sales tax proposal, the letter being dated February 10, 1982. Commr. Carson stated that it was his belief that since this letter had been sent, the Governor may have changed his position concerning this matter. Chris Ford recommended that the Governor's Office be called to confirm the contents of this letter. Discussion occurred regarding the various positions being taken from groups concerning the numerous sales tax bills. Commr. Carson stated he had received some literature on the bill supported by the State Association of County Commissioners and would have each of the Commissioners copied on this literature. No action was taken at this time.

RECESS AND REASSEMBLY

At 2:45 P.M. the Chairman announced that there would be a fifteen (15) minute recess and the Board would reconvene at 3:00 P.M. for the Mobile Home Advisory Board Interviews.

APPOINTMENTS/MOBILE HOME ADVISORY BOARD

At this time the Chairman announced that interviews would be held with persons who had applied for positions on the Mobile Home Advisory Board. Commr. Carson stated that the first group to be interviewed would be those who had applied for the three positions in the category of those with no affiliation with mobile home parks. The applicants for this category appeared as follows to explain to the Board briefly, the reasons they wished to serve on the Mobile Home Advisory Board and to answer any questions the Board might have:

Mr. R. M. Marshall, Leesburg, Florida

John F. Rudy, Mount Dora, Florida

Commr. Carson explained to those present that Mr. Jack Pae had recalled his application and did not wish to be considered. Mr. Robert Corrington had contacted the Board stating that he could not be present but wished the Board to consider his resume. Mr. Jerry L. McDowell had contacted the Board stated that he could not be present due to illness but wished his resume to be considered. Mr. F. E. Merrow could not be present but wished his resume to be considered. Mr. Richard Bair had contacted the Board and stated that although he could not attend he wished his resume to be considered.

At this time the Chairman announced that interviews would start for the applicants in the category of mobile home park owners or managers. Applicants of this category appeared as follows:

Mr. Michael Holland, Cypress Creek, Leesburg, Florida

Mr. Archie Lowry, Continental Country Club, Wildwood, Florida

Mr. Mel Bishop, Water Oak Estates, stated that at the present time Water Oak Estates had fifty (50) residents; however, it was estimated that 650 would be completed by the end of 1982. With the direction of the County Attorney, the Board stated that Mr. Bishop would be considered as a large (over 200 units) park owner or manager

Mr. Archie Lowry, Marketing Manager of Continental Country Club in Wildwood, Florida, although not in Lake County, stated that he resided in Leesburg, and stated that he felt he would have quite a bit of experience to contribute as the manager of a large mobile home park.

At this time the Chairman announced that interviews would be conducted with the applicants in the category of res idents of mobile home parks. The applicants appeared as follows:

Commr. Carson stated that Mr. John Creighton would not be able to attend the interviews due to illness; however, Mr. Creighton wished the Board to consider his resume.

At this time the Board reviewed the resumes of those who were not in attendance for the interviews but wished to be considered for positions on the Mobile Home Advisory Board,

The Chairman announced that each of the applicants had been heard and the resumes of those not present had been reviewed and the floor was open for nominations by the Board.

On a motion by Commr. Deems, seconded by Commr. Burhans and carried unanimously, the Board approved nomination of Mr. R. M. Marshall for a position as a neutral party on the Mobile Home Advisory Board.

On a motion by Commr. Smoak, seconded by Commr. Windram and carried unanimously, the Board approved the nomination of Mr. Robert P. Adkins for a neutral party on the Mobile Home Advisory Board.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved the nomination of Mr. Richard Bair as a neutral party on the Mobile Home Advisory Board.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved the nomination of Mr. Michael Holland, Cypress Creek, as the representative owner/manager of a small mobile home park on the Mobile Home Advisory Board.

On a motion by Commr. Windram, seconded by Commr. Smoak and carried unanimously, the Board approved the nomination of Mr. Mel Bishop, Water Oak Estates, as representative owner/manager of a large mobile home park on the Mobile Home Advisory Board.

On a motion by Commr. Deems, seconded by Commr. Smoak and carried unanimously, the Board approved the nomination of Mr. Harry Galbraith as a representative of mobile home park residents on the Mobile Home Advisory Board.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board approved the nomination of Mr. Louis A. Peters, as a representative of mobile home park residents on the Mobile Home Advisory Board.

At this time the Board addressed the portion of the Ordinance creating the Mobile Home Advisory Board which called for one year terms for the first year in each category. On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the Board approved that the one year nominees would be selected alphabetically, one from each category. The one term members were stated as Mr. Robert Adkins, Mr. Mel Bishop and Mr. Harry Galbraith.

The Board directed that letters be written to each of the applicants advising them of the appointments made and thanking them for the excellent presentations to the Board. The Board directed that a letter be written to each of the new members advising them of their appointment with a list of the other members names and addresses included with the letter.

The Board authorized a staff member of the County Attorney's Office to be present for the organizational meetings of the Mobile Home Advisory Board.

COMMISSIONERS

Let it be noted that Mary C. Grover, Secretary, received and filed Form 4, Memorandum of Voting Conflict, for Commr. C. A. "Lex" Deems and Commr. James R. Carson, Jr., regarding an amendment of Conditional Use Permit #48OC-1 to include additional land in the permit granted on request of the applicant acting as agent for undisclosed principal subsequently discovered to be Silver Lake Golf and Country Club, Inc.

There being no further business to be brought before the Board, the meeting adjourned at 4:40 P.M..
