PROPERTY APPRAISAL ADJUSTMENT BOARD MEETING

September 22, 1982

The Property Appraisal Adjustment Board met on Wednesday, September 22, 1982, at 9:00 a.m. in the Commissioners' Meeting Room, Lake County Courthouse, Tavares, Florida. Members present were: Commr. James R. Carson, Jr., Chairman; Commr. Glenn C. Burhans, Commr. Claude Smoak; and Mrs. Joan Brown, Lake County School Board . Others present were: Mr. Ed Havill, Property Appraiser; Mr. Sanford Minkoff, County Attorney's Office; and Mary C. Grover, Secretary.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board approved the following Homesteads which were approved by Mr. Havill's office prior to the meeting:

PETITION 1982-85 Jessie 0. Prater

Mr. Jessie Prater was present to discuss the denial of

Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason that Homestead Exemption was denied was that Mr. Prater owned the property but he did not own the mobile home which is sitting on the property. Mr. Prater stated the mobile home was included along with the property in the legal description on the deed. Mr. Minkoff, County Attorney's Office, stated he felt Mr. Prater had equitable title to the mobile home as it was included with the property in the deed.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board granted the $25,000 Homestead Exemption as recommended by Mr. Havill, Property Appraiser, and Mr. Minkoff, County Attorney's Office.

PETITION 1982-l Jayne W. Abshear

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied Homestead Exemption as the Petitioner did not reside on the property as of January 1, 1982.

PETITION 1982-3 Valerie K. Anderson

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not reside on the property as of January 1, 1982.

PETITION 1982-4 Homer Bales

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1982.

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Mrs. Brown, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not reside on the property as of January 1, 1982.

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $5,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1982.

PETITION 1982-8 Nancy F. Bland

No one was present to discuss the denial of Homestead Exemption with the Board.

It was noted that a letter had been received by Mrs. Bland regarding the denial of homestead exemption.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not reside on the property as of January 1, 1982.

PETITION 1982-9 Charles E. Boness

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $5,000 Homestead Exemption as the Petitioner did not reside on the property as of January 1, 1982.

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $5,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1982.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1982, (filed March 16, 1982).

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not reside on the property as of January 1, 1982.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $5,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1982.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1982, (filed March 18, 1982).

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $5,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1982.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $5,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1982.

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not have legal title to the property as of January 1, 1982.

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption and Widows Exemption as the Petitioner filed after March 1, 1982, (filed March 2, 1982).

No one was present to discuss the denial of Homestead Exemption and Widows Exemption with the Board.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption and Widows Exemption as the Petitioner filed after March 1, 1982, (filed March 4, 1982).

PETITION 1982-25 David C. Childs

Mr. Childs was present to discuss the denial of Homestead Exemption with the Board.

Mr. Havill, Property Appraiser explained Mr. Child's application for Homestead Exemption had been filed March 27, 1982.

Commr. Carson explained to Mr. Childs that the application for homestead exemption has to be submitted to the Property Appraiser's Office on or before March 1, 1982. He stated the Board did not have the power to approve the homestead exemption if the application was filed after March 1st unless there were extenuating circumstances.

PETITION 1982-63 Fredinand Katulski

Mr. Katulski was present to discuss the denial of Homestead Exemption with the Board.

Mr. Havill, Property Appraiser, informed the Board Mr. Katulski filed for Homestead Exemption on March 8, 1982.

Mr. Katulski informed the Board that his daughter had been ill and he had stayed with his daughter in Denver, Colorado, from February 12, 1982 until after Easter. He stated he did not get his mail until March 5, 1982.

Mr. Minkoff, County Attorney's Office, stated he felt it would be legally difficult to grant the Homestead Exemption.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried, the Board upheld the recommendation of the Property Appraiser and denied the Homestead Exemption as the Petitioner filed after March 1, 1982, (filed March 8, 1982).

Mrs. Brown voted "No".

PETITION 1982-103/104 0. D. Stephens, Sr.

Mr. Stephens was present to discuss the denial of Homestead Exemption and Disability Exemption with the Board.

Mr. Havill, Property Appraiser, stated the reason that Mr. Stephens Homestead Exemption was denied was that Mr. Stephens did not reside on the property as of January 1, 1982.

Mr. Stephens stated he had moved from Mt. Dora (property being denied Homestead and Disability Exemptions) to Eustis September, 1981.

On a motion by Mrs. Brown, seconded by Commr. Smoak and carried unanimously, the Board upheld the recommendation of Mr. Havill, Property Appraiser, and granted Mr. Stephens the $25,000 Homestead Exemption and Disability Exemption on his Eustis residence and denied Homestead Exemption and Disability Exemption on the house in Mt. Dora.

PETITION 1982-56 J. Lewis Holland

Mrs. Gale Holland was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1982, (filed March 8, 1982).

PETITION 1982-64 Henry J. Kerrison

Mr. Kerrison was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Mrs. Brown, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1982, (filed March 2, 1982).

Mr. Eastwood was present to discuss the denial of Homestead Exemption with the Board.

PETITION 1982-88 Joseph Rathbun

Mr. Rathbun was present to discuss the denial of Homestead Exemption. He stated that he had been residing on the property in Mt. Dora as of January 1, 1982, and that he has since moved (January 30, 1982) to a new location.

On a motion by Mrs. Brown, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and granted Homestead Exemption to Mr. Rathbun.

PETITION 1982-49 Dean Grussing

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried, the Board upheld the recommendation of the Property Appraiser and denied the $5,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1982.

Commr. Burhans was not present for the vote.

No one was present to discuss the denial of Homestead Exemption with the Board.

Mr. Rivers was present to discuss the denial of Homestead Exemption with the Board.

Mr Havill, Property Appraiser, informed the Board that Mr. River's home had burnt to the ground in June, 1981. Mr. Havill, Property Appraiser, informed the Board the reason that homestead exemption had been denied was that the Petitioner did not have legal title to the property as of January 1, 1982.

Mrs. Paquette presented the Board with a deed which had been witnessed but had not been notarized or recorded.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and Mr. Minkoff, County Attorney's Office, and granted the Petitioner the $25,000 Homestead Exemption.

PETITION 1982-189 Annanias Wright

Mr. Wright and his daughter were present to discuss the denial of Homestead Exemption with the Board.

Mr. Havill, Property Appraiser, informed the Board the reason the homestead exemption had been denied was that there was not a house on the property.

Mr. Wright's daughter presented the Board with a deed of where Mr. Wright is currently living. Mr. Havill stated the date of the deed was May 3, 1982, recording date May 14, 1982. He questioned if Mr. Wright had a contract to purchase the property prior to January 1, 1982.

The Board postponed this case until Mr. Minkoff, County Attorney's Office, could contact Mr. Wright's attorney regarding the deed.

Mr. Minkoff, County Attorney's Office, informed the Board Mr. Wright's attorney was not in the office. He recommended the Board deny the Homestead Exemption and authorize Mr. Havill, Property Appraiser, to work with Mr. Wright and his attorney in order to get the situation corrected. Mr. Havill, Property Appraiser, recommended the Board grant the Homestead Exemption.

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and granted the $25,000 Homestead Exemption.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1982, (filed September 20, 1982).

PETITION 1982-194 Willard Keller

Mr. & Mrs Keller were present to discuss the Petition with the Board. Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment of Mr. Keller's property was $63,550.00. He stated Mr. Keller felt the assessment should be $54,000.00. He further stated Mr. Keller felt the house was an over improvement in the area and the field appraiser, in consideration of the fact, allowed a ten (10) percent reduction on the house. He further explained that a screen porch had been added which reduced the allowance given.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board upheld the Property Appraiser's assessment of $63,550.00.

PETITION 1982-199 George G. Wright, Jr.

Mr. Wright was present to discuss the Petition with the Board. Mr. Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment of Mr. Wright's property was $130,790.00. He stated that Mr. Wright has been granted an agricultural classification for 69 acres of land and that land is currently assessed for $27,000.00. Mr. Wright stated he felt his residence should be lowered to $72,162.00 (assessed by Property Appraiser at $86,210.00).

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board approved to reduce Mr. Wright's land assessment from $27,000.00 to $22,000.00; therefore reducing Mr. Wright's assessment to $125,790.00.

PETITION 1982-201 Kenny D. & Patricia Perkins

Mr. & Mrs. Perkins was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $103,620.00.

Mr. Perkins stated he was objecting to the barn assessment of $19,320 and the house assessment of $70,300.00 He stated the barn was a pole barn.

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser's Office and reduced the assessment of the barn to $10,000.00.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board upheld the Property Appraiser's adjusted assessment of $94,300.00.

PETITION 1982-203 Olive L. Eckerson

Mrs. Eckerson was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $44,000. He further stated Mrs. Eckerson had been denied the agricultural classification for 1982 as the grove property had been abandoned.

Mrs. Eckerson informed the Board that she did not have access onto her property.

Mr. Sanford Minkoff, County Attorney's Office, stated that a suit is pending against Lake County. He stated Mrs. Eckerson's land is at the end of the driveway at the Astatula Landfill. He stated the County has not acknowledged that the road is a public road. He stated the reason the driveway was locked was so that people would not dump refuse at the entrance of the landfill. He stated that if the County moved into the new portion and out of the old portion, the gate could be moved and the road would be opened enabling Mrs. Eckerson access to her property.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board overturned the Property Appraiser's assessment and reduced the assessment to $32,000.00 ($800 per acre).

PETITION 1982-215 Harold F. Clauer

Mr. Clauer was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $40,163.00

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board upheld the Property Appraiser's assessment of $40,163.00.

PETITION 1982-216 Hildegard Sender

MS. Sender was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $71,280.00.

Ms. Sender explained to the Board that her home was not air conditioned. Mr. Williams stated he would agree to lower the assessment by $1,566.00..On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board upheld the Property Appraiser's recommendation to remove the air conditioning cost ($1,566.00) from the assessment, subject to the Property Appraiser's confirmation that there is not an air conditioning unit on the property.

On a motion by Commr. Burhans, seconded by Mrs. Brown and carried, the Board upheld the Property Appraiser's adjusted assessment of $69,714.00.

PETITION 1982-221 LeRoy Hedstrom

Mr. Hedstrom was present to discuss the Petition with the Board.

Mr. Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $76,770.00.

Mr. Hedstrom stated he had completed his home in 1981 and felt that his assessment on home should be $52,830.00. He stated his home had been built by Hungerford Homes.

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board overturned the Property Appraiser's assessment of $76,770.00 and lowered the assessment to $65,007.00.

PETITION 1982-265 Osias G. Goren

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board upheld the Property Appraiser's adjusted assessment of $905,182.00.

PETITION 1982-245 James K. Lee

Mr. Lee was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $91,459.00. He stated this Petition was regarding Homestead Exemption. He stated that Mr. Lee bought the house in 1981 and had received homestead exemption by the previous property owner. He further stated that Mr. Lee did not receive an automatic renewal card because anytime a person buys a new piece of property as their new residence, they have the obligation of going to the Property Appraiser's Office and filing a new form. He explained Mr. Lee did not come into the Office and file a new form; therefore, he was not granted Homestead for 1982.

Mr. Minkoff, County Attorney's Office, stated the property owner has the responsibility to apply for Homestead Exemption.

On a motion by Commr. Smoak, seconded by Commr. Burhans and carried unanimously, the Board upheld the Property Appraiser's assessment of $91,459.00.

PETITION 1982-244 Hubert & Glenda Mann

Commr. Carson explained to the Board he had received a telephone call from Mr. Mann. He stated Mr. Mann had received a subpeona to appear in court and was requesting the Board postpone his Petition until September 23, 1982.

On a motion by Commr. Smoak, seconded by Mrs. Brown and carried unanimously, the Board postponed this Petition until the last order of business on September 23, 1982.

PETITION 1982-245 William C. Campbell et al.

Mr. William Campbell was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $76,046.00. He stated that the property consisted of 15 acres of Ocoee Sand. He explained that Ocoee Sand is sand that is up against a shoreline and is subject to flooding. He stated the land level is too low to build on.

Commr. Smoak suggested the Board postponed this Petition until tomorrow, September 23, 1982, and contact Pollution Control to conduct a site evaluation study to determine if the land can be developed. He stated, that in his opinion, he felt that Pollution Control would approve development for residential use on the property.

Discussion occurred regarding the development of surrounding properties. Mr. Campbell stated the land was higher than this piece of property.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board overturned the Property Appraiser's assessment of $76,046.00 and lowered the assessment to $69,460.00 (1981's assessment) due to the question of whether the land can be developed.

Mr. Marthinsen was present to discuss the Petitions with the

Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board he would like Petitions 1982-205, 1982-206, 1982-207, 1982- 208, 1982-209, and 1982-210 to be discussed at the same time and Petitions 1982-211, 1982-212, and 1982-213 to be discussed at the same time. Mr. Williams informed the Board the Property Appraiser's Office had not received Mr. Marthinsen's applications for agricultural classification on the properties. He stated that had the Property Appraiser's Office received the applications, they would have been denied due to the property being zoned to a non-agricultural use and being a recorded and platted subdivision.

Mr. Marthinsen explained that he had cattle on his property and is in the process of growing trees. He further stated that he had filed for agricultural exemption on all of his properties for 1982. Be stated another person was using the property to graze the cattle and that he had a verbal agreement with the person.

Mr. Marthinsen presented the Board with a copy of a map of his property and page 2 of his report. Mr. Marthinsen gave a brief report of the situation.

Mr. Sanford Minkoff, County Attorney's Office stated that Lake Murphy Estates (Lots 14-21) was platted and recorded in 1977. He further stated the property is currenty zoned Residential.

The Board suggested that each Petition be discussed individually.

It was noted that Petitions 1982-211, 1982-212, and 1982-213 are not a part of Lake Murphy Estates. Mr. Marthinsen stated that Lots 4 & 5 should be considered as one parcel; Lots 6 & 8 as one parcel; and Lots 7 & 9 as one parcel. He stated that the deeds show the above lots as three individual parcels not six individual parcels.

Mr. Jim Loflin, Property Appraiser's Office, was present to answer any questions the Board might have.

Mr. Williams stated his appraiser had been out to view the property and that he did not see any cattle grazing on the property. He further stated that there was a fence erected between the Lake Murphy Estates lots and the other three parcels.

Mr. Williams further stated that the agricultural classification had been approved for Lots 4, 6, and 7.

On a motion by Commr. Burhans, seconded by Commr. Smoak and carried unanimously, the Board postponed the Petitions submitted by Mr. Marthinsen until September 23, 1982, at 9:00 a.m. at such time that Mr. Havill, Property Appraiser, and Mr. Loflin, Property Appraiser's Office, can be present.
