PROPERTY APPRAISAL ADJUSTMENT BOARD MEETING

September 26, 1983

The Property Appraisal Adjustment Board met on Monday, September 26, 1983, at 9:00 a.m. in the Commissioners' Meeting Room, Lake County Courthouse, Tavares, Florida. Members present were: Commr. Thomas J. Windram, Chairman: Commr. Glenn C. Burhans; Commr. James R. Carson, Jr.; Mrs. Anna Cowin, Lake County School Board; and Mrs. Kyleen Fischer, Lake County School Board. Others present were Mr. Ed Havill, Property Appraiser; Mr. Harold Williams, Chief Field Appraiser; Mr. Sanford Minkoff, County Attorney's Office; and Robin R. York, Secretary.

MINUTES

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board approved the Minutes of the Organizational Meeting of the Property Appraisal Adjustment Board of August 18, 1983, as submitted.

PROPERTY APPRAISER/HOMESTEAD WRITTEN WITHDRAWALS ACCEPTED

On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board accepted the written withdrawals for the following, who had been denied Homestead Exemption:

PETITION 1983-l William D. Alexander

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Carson, seconded by Mrs. Fisher and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied Homestead Exemption as the Petitioner had filed for Homestead on two homes. Mr. Alexander was granted Homestead Exemption on his new home and denied the $25,000 Homestead Exemption on his old home.

PETITION 1983-2 John E. Bradley

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not meet residency requirements as of January 1, 1983.

PETITION 1983-21/22 Emogene Gamble

Ms. Emogene Gamble was present to discuss the denial of Homestead Exemption and Widow's Exemption with the Board.

Commr. Windram informed the Petitioners on current laws regarding late filing of the Homestead Exemption.

Mr. Ed Havill, Property Appraiser, informed the Board the reason that Homestead Exemption was denied was that Ms. Gamble filed after March 1, 1983. Ms. Gamble stated that she has been totally disabled for two years, and that she had also been confused as to the date of filing for Homestead Exemption.

Mr. Sanford Minkoff, County Attorney's Office, reiterated Commr. Windram's statements regarding late filing for Homestead Exemption.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendatin of the Property Appraiser and denied the $25,000 Homestead Exemption and Widow's Exemption as the Petitioner filed after March 1, 1983 (filed March 4, 1983).

PETITION 1983-17 James A. Davis

Mrs. Davis was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that the reason Homestead Exemption was denied was that Mr. Davis filed on March 4, 1983. Mrs. Davis stated her husband has mental problems and that she had surgery in February and March.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983 (filed March 4, 1983).

PETITION 1983-13 Georgia A. Cone

Ms. Georgia A. Cone was present to discuss the denial of

Homestead Exemption with the Board.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983.

PETITION 1983-50 Elmer J. Sowden

Mr. Sowden was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason that Homestead Exemption was denied was that Mr. Sowden filed on March 3, 1983.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983. (filed March 3, 1983).

PETITION 1983-40 Santiago Perez

Mr. and MS. Perez were present to discuss the denial of

Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason that Homestead Exemption was denied was that the title was not in Mr. Perez's name as of January 1, 1983, but rather in the name of Enfran Ochoa.

Ms. Perez stated that the title is in the name of Santiago Perez. Upon review of the title by Mr. Havill, it was recommended that the Board approve Homestead Exemption for Mr. Perez.

On a motion by Commr. Carson, seconded by Mrs. Cowin and carried unanimously, the Board upheld the recommendation of the Property Appraiser and approved the $25,000 Homestead Exemption for Santiago Perez.

PETITION 1983-39 Abdel K. Nesheiwat

MS. Nesheiwat was present to discuss the denial of Homestead

Exemption with the Board.

On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1983 (filed March 7, 1983).

PETITION 1983-37 Valery Miles

Mr. Miles was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1983 (filed March 8, 1983).

PETITION 1983-42 James W. Prescott

Mr. Prescott was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board as of January 1, 1983, Mr. Prescott did not have the title to the recreation vehicle in which he was living, although he did have title to the land. It was further stated that Mr. Prescott moved into his own mobile home on January 4, 1983. Mr. Havill recommended that the Board approve Homestead Exemption for James W. Prescott.

On a motion by Commr. Carson, seconded by Mrs. Fischer and carried unanimously, the Board upheld the recommendation of the Property Appraiser and approved the $25,000 Homestead Exemption for James W. Prescott.

PETITION 1983-45 Manuel Rojas

Mr. Rojas was present to discuss the denial of Homestead

Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason that Homestead Exemption was denied was that Mr. Rojas filed after March 1, 1983.

Mr. Rojas stated he mailed his application for Homestead Exemption before 9:00 a.m. on March 1, 1983, and that it is the internal policy of the Post Office that all local mail not directed to Leesburg, goes first to Orlando, thus causing a postmark of a later date. Mr. Havill stated that the U. S. Postal Service is the agent that Mr. Rojas has chosen and that it is not the agent of the Property Appraiser's Office.

Commr. Windram read the letter from Mr. H. Elliott,

Superintendent of Mails and Delivery, reiterating Mr. Rojas' reason for the late postmark.

On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board referred the matter to Mr. Sanford Minkoff, County Attorney's Office, to be investigated and to report the finding to the Board later in the day.

PETITION 1983-94 Thomas H. Errair

Mr. Errair was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that the reason Homestead Exemption was denied was that Mr. Errair filed after March 1, 1983. The application shows that it was stamped and received into the Property Appraiser's Office on March 28, 1983. The U. S. Postal stamp showed no cancellation and the applicant had signed and dated the application, February 14, 1983.

Mr. Errair stated that he had mailed his application for Homestead Exemption on February 14, 1983 and that he did not hand deliver it to the Property Appraiser's Office.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board withheld judgment until the Property Appraiser could determine how the stamp was put on the application.

PETITION 1983-57/58 Edythe W. Walker

Mrs. Walker and Mr. Steven Birr, Attorney representing Mrs. Walker, were present to discuss the denial of Homestead Exemption and Widow's Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that his attorney stated that since Mrs. Walker does not appear to have legal or beneficial title and equity, no Homestead Exemption could be granted. Mr. Steven Birr stated that the only requirement for the Land Trust is that it be revocable and it is his opinion that it is revocable. Mr. Havill stated that upon review of the Agreement by his attorney, it was determined that the Agreement was not revocable.

Mr. Sanford Minkoff, County Attorney's Office, stated that one additional sentence in the Agreement would make the trust qualify for Homestead Exemption. Mr. Havill stated he would be willing to grant Homestead Exemption to Mrs. Walker if a corrected instrument was sent to his office. Mr. Birr stated he would be willing to clear up the language in the Agreement to satisfy the Board.

On a motion by Commr. Carson, seconded by Mrs. Cowin and carried, the Board approved the $25,000 Homestead Exemption and Widow's Exemption, subject to receipt of an ammended Trust Agreement that is satisfactory in wording and terminology to the Property Appraisal Adjustment Board, Mr. Minkoff, Mr. Havill, and Mr. Havill's attorney.

Commr. Windram and Commr. Burhans voted no.

PETITION 1983-94 Thomas H. Errair

Mr. Ed Havill, Property Appraiser, stated it has been determined that Mr. Errair's application for Homestead Exemption was hand delivered to the Property Appraiser's Office on March 28, 1983.

On a motion by Commr. Carson, seconded by Mrs. Fischer and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1983 (filed March 28, 1983).

PETITION 1983-54 Vester A. Stephens

Mr. Stephens was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason for denial of Mr. Stephen's Homestead Exemption was that he filed after March 1, 1983.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983 (filed March 2, 1983).

PETITION 1983-62 Adam L. Wilburn

Mrs. Wilburn was present to discuss the denial of Homestead

Exemption with the Roard.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983 (filed March 8, 1983).

PETITION 1983-63 R. B. Williams

Mr. Williams was present to discuss the denial of Homestead

Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason for denial of Mr. Williams' Homestead Exemption was that he filed after March 1, 1983.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983 (filed March 2, 1983).

PETITION 1983-114 Julian R. Jucha

Mr. Jucha was present to discuss the denial of Homestead

Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that Mr. Jucha filed for Homestead Exemption on March 24, 1983.

Mr. Jucha stated he realized that he was late, but hoped the Board would take into consideration the fact that neither he nor his wife are employed, nor do they receive Social Security and that they are on a tight budget.

Commr. Windram explained that the Board is bound to operate under the State Statutes which has no provision for those who file late.

On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board upheld the Property Appraiser's recommendation and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983 (filed March 24, 1983).

PETITION 1983-115 Charles Kaslly

Ml-. Kaslly was present to discuss the denial of Homestead Exemption with the Board

Mr. Ed Havill, Property Appraiser, informed the Board that Mr. Kaslly did not occupy the property until January 19, 1983. Mr. Kaslly stated that he was denied Homestead Exemption due to moving.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not reside on the property by January 1, 1983.

PETITION 1983-120 Dean E. Mathias

Mr. Mathias was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that the reason Homestead Exemption was denied was that Mr. Mathias had no proof of legal Florida residency as of January 1, 1983. Mr. Mathias showed proof of a Florida Driver's License, issued on March 9, 1983 and proof of voter's registration, dated February 2, 1983. Mr. Havill recommended approval of Homestead Exemption for Mr. Mathias.

On a motion by Commr. Carson, seconded by Mrs. Cowin and carried unanimously, the Board upheld the recommendation of the Property Appraiser and granted Mr. Mathias the $25,000 Homestead Exemption.

PETITION 1983-136 Kenneth A. Sims

Mr. and Mrs. Sims were present to discuss the denial of Disabled Veterans Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason that the Disabled Veterans Exemption was denied was that Mr. Sims filed on March 22, 1983.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the Property Appraiser's recommendation and denied the $25,000 Disabled Veterans Exemption.

PETITION 1983-152 Raymond R . Deford

Mrs. Deford was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that the reason Homestead Exemption was denied was that Florida residency requirements were not met as of January 1, 1983. Mr. Havill further stated he had received a letter from Mr. and Mrs. Deford requesting cancellation of their Homestead Exemption for 1983, as they are Indiana residents.

Mrs. Deford stated she did not know how to determine residency; they live in Florida six months out of a year.

Mr. Havill explained that under Florida law, if someone falsely files for Homestead Exemption, there is up to a $5,000 fine and a year in jail.

On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board upheld the Property Appraiser's recommendation and denied the $25,000 Homestead Exemption, as the Petitioner did not meet residency requirements as of January 1, 1983.

PETITION 1983-188 Donald L. Wiley, Sr.

Mr. Wiley was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that Mr. Wiley filed a Property Appraisal Adjustment Board Petition and has not filed for Homestead Exemption for this year.

Mr. Wiley stated that the Post Office changed his address, thus he did not receive notification from the Property Appraiser's Office.

On a motion by Commr. Carson, seconded by Mrs. Fischer and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption.

PETITION 1983-142 Nguyen Thaun

Mr. Nguyen Thaun and Mr. Charles Holmes, Employer for, and

representing Mr. Thaun were present to discuss the denial of

Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board the reason Homestead Exemption was denied was that Mr. Thaun filed on March 30, 1983. Mr. Holmes stated that Mr. Thaun was unaware that he needed to file for Homestead Exemption and that he has paid 100% of his taxes since he has moved to this country in 1975.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the Property Appraiser's recommendation and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1983 (filed March 30, 1983).

PETITION 1983-161 Ronald 0. Ashley

Mr. Ashley was present to discuss the denial of Homestead Exemption with the Board.

Mr. Ed Havill, Property Appraiser, informed the Board that Mr. Ashley owns a piece of property in the name of a corporation. It is the opinion of the Property Appraiser's attorney that the corporation does not qualify for Homestead Exemption under Florida law.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption.

PETITION 1983-21/22 Emogene Gamble

Mrs. Gamble stated that she did not file for Homestead Exemption four days late, but filed on March 3, 1983.

PETITION 1983-163 John F. Peterson

Mr. Peterson was present to discuss the Petition with the Board.

Mr. Peterson stated his property was zoned Agricultural, but would like to have it classified Agricultural.

Mr. Harold Williams, Chief Field Appraiser, informed the Board that the Agricultural application was denied, as the property does not currently qualify for Agricultural Exemption.

Mr. Peterson further stated that he received a bid for $900.00 from the trees on 6 acres of his property.

Mr. Sanford Minkoff, County Attorney's Office, cited the Statutory criteria for Agricultural classification.

On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board approved Agricultural Exemption for 6 acres and denied Agricultural Exemption for 9 acres.

PETITION 1983-164 Elmer B. Tingle

Mr. Tingle was present to discuss the Petition with the Board.

Mr. Tingle stated that the freeze of 1981 had destroyed much of his grove, leaving approximately 300 trees. He further stated that he has put in an irrigation well and plans to restore the entire fifteen acres.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board granted Agricultural Exemption to Mr. Tingle.

Mr. Ed Havill, Property Appraiser, stated that the Property Appraiser's Office would view Mr. Tingle's property as a commercially feasible grove and assess the grove as one would be assessed in the same condition, and that Mr. Tingle would receive a notice from the Board after the Board's final meeting.

PETITION 1983-165/172 John Marthinsen

Mr. Marthinsen was present to discuss the Petition with the

Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the reason Mr. Marthinsen was denied Agricultural Exemption was that his property is part of Lake Murphy Estates and fronts on State Road 439. He further stated that this property is zoned residential and there is nothing to indicate that the property comes under the Green Belt Law.

Mr. Marthinsen stated that he is in the business of buying and selling fruit and shade trees, and landscape plants. Mr. Marthinsen stated he had bought 2,000 Red Cedar amd Northern Slash Pine trees from the Forestry Service, held lumbering operations with Georgia-Pacific Corporation, and purchased a machine to be used in the planting of trees. Mr. Marthinsen presented photographs as evidence of these activities involved on his property.

Mr. Havill stated that it is his contention that it is not a commercially Agricultural piece of property.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board denied the Agricultural Exemption and upheld the Property Appraiser's assessment.

PETITION 1983-176 Carl J . Saxon

Mr. Carl J. Saxon and Mr. Richard Taylor, representing Mr. Saxon, were present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment was $35,290.

Mr. Saxon stated that his two neighbor's houses, which were built at about the same period of time, were assessed at a lower value than his and that his neighbors had made improvements, whereas he had made no improvements.

Mr. Richard Taylor stated that an adjustment was in order and the assessment should be lowered by $3,000 or $4,000.

Mr. Ed Havill, Property Appraiser, stated that Mr. Saxon's property is 7%-8% better than the adjoining properties.

Mr. Sanford Minkoff stated that the Board is here only to determine if the appraisal made by the Property Appraiser is fair and justly valued, as defined in the Statutes of the Constitution.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the Property Appraiser's assessment of $35,290.00.

PETITION 1983-196/199 Conway D. Kittredge

Mr. Carter Moore, attorney representing Mr. Kittredge, was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board that Mr. Kittredge had filed March 10, 1983.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board denied the Agricultural Exemption for Mr. Kittredge.

PETITION 1983-181 Sigurd J. Hellstrom

Mr. Robert Geyman, representing Mr. Hellstrom, was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board that Mr. Hellstrom's assessment increased 10% as opposed to other related properties which increased 5%; this was due to a previous error which had been corrected this year. Previously, Mr. Hellstrom's property was coded 00, instead of being coded 01.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board upheld the Property Appraiser's assessment of $80,212.00.

RECESS & REASSEMBLY

At 12:20 p.m. the Chairman announced the Board would recess for lunch. The Board reconvened at 1:05 p.m.

PETITION 1983-182 Jesse E. Murray

Mr. Murray was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the Property Appraiser's assessment of Mr. Murray's property was $82,976.00. He stated Mr. Murray felt his assessment should be lowered, based upon the assessments of his neighbor's properties.

At this time the Board and Mr. Murray reviewed the assessments of the properties in question.

Mr. Ed Havill, Property Appraiser, suggested that the Property Appraiser's Office look at Mr. Murray's property and make a final decision when the Board reconvenes October 4, 1983, or reclassify Mr. Murray's house from a 6+ to a 6 classification, reducing the assessment by $4,000.00.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, The Board upheld the recommendation of the Property Appraiser to reclassify Mr. Murray's house, lowering the 6+ classification to a 6 classification, and reducing the assessment to $78,976.00.

PETITION 1983-185/186 Patricia K. Newberry

Ms. Newberry was present to discuss the denial of Homestead

Exemption with the Board.

On a motion by Commr. Carson, seconded by Commr. Burhans, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1983 (filed September 12, 1983).

PETITION 1983-187 S. N. Knight & Sons, Inc.

Mr. Ed Havill, Property Appraiser, informed the Board that Mr. Steve Williams telephoned to withdraw the Petition for S. N. Knight & Sons, Inc.

On a motion by Commr. Carson, seconded by Mrs. Fischer and carried unanimously, the Board approved the withdrawal of Petition 1983-187.

PETITION 1983-191/194 John A. Boll

Mr. Gus Jicha, representing Mr. Boll, was present to discuss the Petition with the Board.

Petition 1983-191 and Petition 1983-192 were adjusted prior to the Property Appraisal Adjustment Board meeting and not discussed before the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board the reason for Mr. Boll's increased assessment was due to the increased number of spaces occupied in the mobile home rental park.

On a motion by Commr. Carson, seconded by Mrs. Cowin and carried unanimously, the Board upheld the recommendation of the Property Appraiser's assessment for 1983.

PETITION 1983-3 Charlie W. Birdsong, Jr.

No one was present to discuss the denial of Homestead Exemption with the Board.

On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board uphelp the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner filed after March 1, 1983.

Mrs. Schafer was present to discuss the Petition with the Board.

Mr. Harold Williams, Chief Field Appraiser, informed the Board that Mrs. Schafer's increased assessment was due largely to the addition of a mobile home on her property, requiring the cut of a one acre homesite.

Mrs. Schafer felt that the assessment was too high due to the fact that mobile homes depreciate in value.

It was brought to the attention of the Board that the deck was included in the assessment, being an addition of 1983.

Mr. Ed Havill, Property Appraiser, took the deck into consideration, reducing the assessment by $1,150.00.

On a motion by Commr. Carson, seconded by Mrs. Fischer and carried, the Board upheld the Property Appraiser's reduced assessment of $48,980.00.
