PROPERTY APPRAISAL ADJUSTMENT BOARD MEETING
September 25, 1984
The Property Appraisal Adjustment Board met on Tuesday, September 25, 1984, at 9:00 a.m. in the Commissioners' Meeting Room, Lake County Courthouse, Tavares, Florida. Members present were: Commr. Glenn C. Burhans, Chairman; Commr. Thomas J. Windram; Commr. Claude E. Smoak, Jr. (arriving at 9:45 a.m.); Mrs. Kyleen Fischer, Lake County School Board; and Mrs. Georgia Phillips, Lake County School Board. Others present were Mr. Ed Havill, Property Appraiser; Mr. Sanford Minkoff, County Attorney's Office: and Robin R. York, secretary.
PROPERTY APPRAISER/HOMESTEADS APPROVED
On a motion by Commr. Windram, seconded by Mrs. Fischer and carried unanimously, the Board approved the following Homesteads which were approved by Mr. Havill's office prior to the meeting:

PETITION 1984-3 Hugh Alger
No one was present to discuss the denial of Homestead Exemption with the Board.
On a motion by Commr. Windram, seconded by Mrs. Fischer and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not have legal or beneficial title to property claimed as homestead as of January 1, 1984.
PETITION 1984-44 William H. Hall
Mr. Hall was present to discuss the denial of Homestead Exemption with the Board.
Mr. Ed Havill, Property Appraiser, informed the Board that
Mr. Hall filed for Homestead Exemption March 5, 1984. Mr. Hall explained his reason for being late in filing was due to an address change.
On a motion by Commr. Windram, seconded by Mrs. Phillips and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-32 Roy L. Dowless
Mr. Dowless was present to discuss the denial of Homestead Exemption with the Board.
Mr. Ed Havill, Property Appraiser, informed the Board that
Mr. Dowless has been granted the $25,000 Homestead Exemption.
On a motion by Commr. Windram, seconded by Mrs. Fischer and carried unanimously, the Board approved the $25,000 Homestead Exemption for Mr. Roy L. Dowless.
PETITION 1984-17 Laconia Cliffin
Ms. Cliffin was present to discuss the denial of Homestead
Exemption with the Board.
Mr. Havill informed the Board the Ms. Cliffin filed for
Homestead Exemption on March 7, 1984.
Mrs. Cliffin stated she was late in filing due to illness.
On a motion by Mrs. Fischer, seconded by Commr. Windram and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-10 Kate Y. Bell
Ms. Bell was present to discuss the denial of Homestead
Exemption with the Board.
Mr. Havill, Property Appraiser, informed the Board that the Petitioner filed for Homestead Exemption on March 14, 1984.
Ms. Bell stated that she did not file for Homestead Exemption timely, due to illness.
On a motion by Commr. Windram, seconded by Mrs. Fischer and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-93 Earl C. Taylor
Ms. Taylor was present to discuss the denial of Homestead Exemption with the Board.
Mr. Havill, Property Appraiser, informed the Board that the Petitioner filed for Homestead Exemption March 14, 1984.
Ms. Taylor stated she was late filing for Homestead Exemption due to illness.
On a motion by Mrs. Fischer, seconded by Mrs. Phillips and carried unanimously, the Board upheld the recanmendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETI'IION 1984-73 Lewray L. Pettis
Mr. Pettis was present to discuss the denial of Homestead Exemption with the Board.
Mr. Havill, Property Appraiser informed the Board that the
Petitioner filed for Homestead Exemption March 20, 1984.
Mr. Pettis stated he received notification to file for
Homestead Exemption in the mail after the deadline of March 1, 1984.
Mr. Havill stated it was the property owners responsibility to come in and file for Homestead Exemption.
On a motion by Mrs. Fischer, seconded by Mrs. Phillips and carried unanimously, the Board upheld the recanmendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-116 D.O. Caddell
Mr. Hunter, Attorney representing Mrs. D.O. Caddell, was present to discuss the denial of Homestead Exemption with the Board.
Mr. Havill, Property Appraiser, informed the Board that D.O. Caddell has been granted the $25,000 Homestead Exemption.
PETITION 198441 Gladys J. Griffith
Ms. Griffith was present to discuss the denial of Homestead
Exemption with the Board.
Mr. Havill, Property Appraiser, informed the Board that the
Petitioner did not reside on her property until February 7, 1984.
On a motion by Commr. Windram, seconded by Mrs. Phillips and seconded unanimously, the Board upheld the recanmendation of the Property Appraiser and denied the $25,000 Homestead Exemption as the Petitioner did not make the property claimed as homestead her permanent residence as of January 1, 1984.
PETITION 1986-86 Steve B. Shumaker
Ms. Shumaker was present to discuss the denial of Homestead Exemption with the Board.
Mr. Havill informed the Board that the Petitioner filed for
Homestead Exemption March 27, 1984.
On a motion by Mrs. Fischer, seconded by Mrs. Phillips and carried unanimously, the Board upheld the recanmendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-80 Frank Romano
Ms. Romano was present to discuss the denial of Homestead Exemption with the Board.
Mr. Havill informed the Board that the Petitioner filed for Homestead Exemption April lb, 1984..On a motion by Commr. Windram, seconded by Mrs. Fischer and carried unanimously, the Hoard upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-120 Lorni I. Hopkins
Ms. Hopkins was present to discuss the denial of Homestead
Exemption with the Hoard.
Mr. Havill informed the Board that the Petitioner filed for
Homestead Exemption August 22, 1984.
Ms. Hopkins stated she was not aware of the need to refile
for Homestead Exemption after moving.
On a motion by Mrs. Fischer, seconded by Mrs. Phillips, and
carried unanimously, the Board upheld the recommendation of the
Property Appraiser and denied the $25,000 Homestead Exemption, as
the Petitioner filed after March 1, 1984.
PETITION 1984-87 George E. Shyngle
Mr. Shyngle was present to discuss the denial of Homestead
Exemption with the Hoard.
Mr. Havill informed the Board that the Petitioner did not
sign his application, making the application for Homestead Exemption invalid.
On a motion by Mrs. Fischer, seconded by Mrs. Phillips and carried unanimously, the Board upheld the recanmendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner did not file a valid application.
PETITION 1984-63 Betty M. Locke
Mr. Gary Locke was present to discuss the denial of Homestead Exemption with the Hoard.
Mr. Havil l, Property Appraiser, informed the Hoard that the Petitioner filed for Homestead Exemption March 30, 1984.
Mr . Locke stated the property was in the process of having
the title transferred.
Mr . Minkoff, County Attorney's Office, stated Mr. Locke will be eligible next year for Homestead Exemption if he is residing on the property, and if he will be the one to own the house, and that he must file for Homestead Exemption within the time frame.
On a motion by Mrs. Fischer, seconded by Commr. Smoak and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-109 Gerald Wilson Patrick
Mr. Patrick was present to discuss the denial of Homestead Exemption with the Board.
Mr. Patrick stated he knew that he was late, but that his notice was mailed to an incorrect address.
On a motion by Commr. Smoak, seconded by Mrs. Phillips and carried, the Board granted the $25,000 Homestead Exemption for Mr. Patrick due to an error of the Property Appraiser's office in mailing notification to an incorrect address.
Commr. Windram was not present for the vote.
PETITION 1984-113 Rita Schafer
Mrs. Schafer was present to discuss the Petition with the Board.
Mr. Havill, Property Appraiser, informed the Board that the property did not meet the requirements of the Commercial Agriculture classification. He further stated that the property must show signs of being used commercially by January 1, 1984.
Ms. Schafer stated she did not begin planting in January because she was advised to wait for the rainy season.
On a motion by Commr. Smoak, seconded by Mrs. Phillips and carried unanimously, the Board upheld the recanmendation of the Property Appraiser and denied the Agricultural Exemption, as the Petitioner did not meet the requirements of having a bonafide agricultural operation by January 1, 1984.
PETITION 1984-41 Gladys J. Griffith
MS. Griffith appeared before the Board to inquire about
Mobile Home stickers.
PETITION 1984-125 Diana Zarzemblowski & Dorothy Makowski
Ms. Zarzemblowski was present to discuss the Petition with
the Board. Ms. Zarzemblowski stated she felt her property was over assessed due to part of her property being swampland.
Mr. Havill, Property Appraiser, informed the Board that the property was in line with other comparable properties in the same subdivision.
On a motion by Commr. Smoak, seconded by Mrs. Phillips and carried unanimously, the Board upheld the Property Appraiser's assessment of $4,134.00.
PETITION 1984-57 Johnny Jones
Mr. Jones was present to discuss the denial of Homestead
Exemption with the Board.
Mr. Havill, Property Appraiser, informed the Board that the
Petitioner filed for Homestead Exemption April 2, 1984.
Mr. Jones stated he filed late due to illness.
On a motion by Mrs. Fischer, seconded by Mrs. Phillips and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the $25,000 Homestead Exemption, as the Petitioner filed after March 1, 1984.
PETITION 1984-132 Orval J. & Mary M. Burkhart
Mr. & Mrs. Burkhart were present to discuss the Petition with the Board.
Mr. Havill, Property Appraiser, stated the total assessed value by the Property Appraiser's Office is $41,250.00 and the Petitioner's purchase price was $64,000.00, in December, 1983.
Mrs. Burkhart stated her objections to her assessment were due partly to vegetation overtaking the lake and the odor coming from the dairy. At this time Mrs. Burkhart read a letter to the Board further stating why she objected to her assessment.
On a motion by Commr. Smoak, seconded by Mrs. Phillips and carried unanimously, the Board upheld the Property Appraiser's assessment of $41,250.00.
PETITION 1984-136 Albert Gustafson
Mr. Gustafson was present to discuss the Petition with the Board.
Mr. Havill, informed the Board that the Petitioner paid $20,000.00 for the property in March, 1983. He further stated the property was assessed by his office at $16,790.00 and later adjusted to $13,200.00.
On a motion by Commr. Windram, seconded by Commr. Smoak and carried unanimously, the Board upheld the Property Appraiser's adjusted assessment of $13,200.00.
PETITION 1984-134 Dorothy Y. Weaver
Ms. Weaver was present to discuss the Petition with the Board.
Mr. Havill stated the assessment by the Property Appraiser's Office is $110,700.00. He further stated that the Department of Revenue's assessment for 1983 was $152,935.
Ms. Weaver objected to her assessment due to EDB being present in her water. She presented to the Board a letter from HRS stating EDB is in her well.
On a motion by Commr. Smoak, seconded by Mrs. Phillips and carried unanimously, the Board approved for the Property Appraiser to concur in rolling back the assessed value to the 1982 assessment of $91,980.00 and that Ms. Weaver be in contact with the Property Appraiser's Office should there be a way to clear her water.
PETITION 1984-129 Matthew R. Snowden
Mr. Snowden was present to discuss the Petition with the Board.
Mr. Havill, Property Appraiser, stated all houses in the neighborhood are well-maintained, neat in appearance and in line with comparable properties in the area. Mr. Havill informed the Board the total assessment is $65,150.00
Mr. Snowden stated he objects to his assessment because of a kennel in his neighbor's back yard. He further stated he objected to the increase in the assessment from $45,000.00 to $65,000.00.
On a motion by Commr. Windram, seconded by Mrs. Fischer and carried, the Board approved to adjust the assessment to $55,160.00.
Mrs. Phillips was not present for the vote.
PETITION 1984-128 Gordon F. Averitt
Mr. Averitt was present to discuss the Petition with the
Board.
Mr. Havill informed the Board of the Petitioner's assessment of $34,560.00. Mr. Havill further informed the Board that the property had previously been assessed under an Agricultural classification, but there is no agricultural operation on the property.
On a motion by Commr. Smoak, seconded by Commr. Windram and carried unanimously, the Board upheld the Property Appraiser's assessment of $34,560.00.
PETITION 1984-137 John Paul or Lillian W. Angel
Ms. Lillian Angel was present to discuss the Petition with
the Board.
Mr. Havill, Property Appraiser, informed the Board of the
Petitioner's total assessment of $56,720.00.
Ms. Angel stated she felt her assessment should not be more
than what she has paid, the amount being $52,622.00.
Mr. Havill informed the Board he would be in agreement with
the adjusted figure of $52,622.00.
On a motion by Commr. Smoak, seconded by Commr. Windram and carried unanimously, the Board approved the adjusted assessment of $52,622.00.
PETITION 1984-138 Glen L. & Sabine A. Hermening
Ms. Hermening was present to discuss the Petition with the Board.
Mr. Havill informed the Board of the Petitioner's assessment of $21,002.00.
Ms. Hermening stated she objects to her assessment because of an inferior view of Lake Minnehaha in canparison with the views from the other lots in the subdivision. Ms. Hermening presented to the Board a map of the subdivision lots.
Commr. Smoak stated the developer priced Ms. Hermening's lot lower due to a depression which causes the inferior view.
On a motion by Commr. Smoak, seconded by Mrs. Phillips and carried unanimously, the Board approved to reduce the assessment to the purchase price of $18,000.00, subject to the Property Appraiser's Office reviewing the entire area.
PETITION 1984-133 Robert K. O'Neal
Mr. O'Neal was present to discuss the Petition with the Board.
Mr. Havill informed the Board of the Petitioner's assessment of $58,480.00. Mr. Havill further informed the Board of the
Department of Revenue's 1983 assessment of $73,314.00.
Mr. O'Neal objected to his assessment because his neighbor's assessment is lower, although his neighbor has a larger house, and felt he was being discriminated against because of the DOR's assessment.
At this time the Board postponed Petition 1984-133 until the Property Appraiser could compare Mr. O'Neal's property with his neighbors.
PETITION 1984-139 Glen M. Jones
Mr. Jones was present to discuss the Petition with the Board.
Mr. Havill informed the Board of the Petitioner's assessment of $74,050 and that previously the property was under assessed.
Mr. Jones stated his objection to the assessment is because the assessment doubled in one year.
On a motion by Commr. Smoak, seconded by Commr. Windram and carried unanimously, the Board upheld the Property Appraiser's assessment of $74,050.00.
PETITION 1984-140 Vincent J. Donahue
Mr. Donahue was present to discuss the Petition with the Board.
Mr. Havill informed the Board that Mr. Donahue failed to file for Agricultural Exemption, thus the property being assessed at market value.
Mr. Donahue informed the Board that he did file and that either his application was lost in the mail or an error was made in Mr. Havill's Office, and requested reconsideration be given for Agricultural Exemption, as his assessment has increased from $38,500.00 to $225,000.00. He further stated he felt adjustment was in order due to the freeze damaging his grove.
Mr. Sanford Minkoff, County Attorney's Office, informed the Board that there are no legal grounds for granting Agricultural Exemption.
On a motion by Mrs. Fischer, seconded by Mrs. Phillips and carried unanimously, the Board upheld the Property Appraiser's assessment of $225,000.00.

Mr. Havill informed the Board that Mr. O'Neal's assessment
is higher than his neighbor's due to higher quality construction.
On a motion by Mrs. Fischer, seconded by Commr. Windram and carried unanimously, the Board upheld the Property Appraiser's assessment of $58,480.00.
RECESS AND REASSEMBLY
At 12:20 p.m. the Chairman announced the Board would recess for five minutes. The Board reconvened at 12:30 p.m. to resume hearings for the Property Appraisal Adjustment Board.

On a motion by Commr. Smoak, seconded by Commr. Windram and carried unanimously, the Board upheld the Property Appraiser's assessment of $31,802.00.
PROPERTY APPRAISER
There being no further business to be brought to the attention of the Board at this time, the Chairman announced the Property Appraisal Adjustment Board would meet October 2, 1984, at 8:55 a.m. to approve the minutes and to adopt any changes. The meeting adjourned at 1:00 p.m.
